In the case of Renuka v. Yelaguresh, the Karnataka High Court has ruled that the orders that
are passed under section 12 of Protection of Women from Domestic Violence Act may be enforced in
the similar manner as it is laid down in section 125 of the Code of Criminal Procedure. Justice HT Narendra
reads as the combined reading of sections 20 and 12 of Domestic Violence Act read with Rule 65 of
the Rules clearly indicates that the order that is passed under section 12 can be enforced in the
same manner as it is laid down under section 125 of CrPC. From the language of section 12 of DV Act,
clearly states that the parties can file the application before a jurisdictional magistrate and the
the Magistrate can issue a warrant for every breach of order by levying the amount that is due in the
the similar manner that is provided for levying fines and may pass the sentence.
