One Week National Workshop on Intellectual Property Rights and Innovation @ RGNUL-Punjab from 22-26 November 2021

The Rajiv Gandhi National University of Law, Punjab since its inception has been making rapid progress in professional and academic excellence in the field of legal education with its dedicated faculty members, staff and students under the able guidance and supervision of its Vice-Chancellor, visionaries, well-wishers and members of different Statutory bodies of the University.

The RGNUL, Punjab is having intake of 180 students in Five-Year Integrated B.A.LL.B.(Hons.) and 40 students in LL.M. (Postgraduate) Degree program and Ph.D. Scholars including Business Law including IPR, Constitutional Law, Criminal Law and International Law specialization areas of law since inception. However, university has admitted 16th Batch of B.A.LL.B. (Hons.) and 15th Batch of LL.M. (Postgraduate) Degree program during 2021.

However, RGNUL, Punjab is aimed of teaching and research in IPR specialization course which is to synergies all types of IPRs in all the field of sciences, technologies, engineering and other field of studies and further to promoting the innovations in the interest of all the stake holders with appropriate Law.  RGNUL, Punjab itself has established as the Nodal Center of Academics and Professionalism in legal education and yet to establish in specializing of Intellectual Property Clinics (IP Clinics). The University has created 17 Centers for Advanced Studies and Research, which are dedicated in promoting various legal clinics in the field of Law. Prof. (Dr.) Naresh Kumar Vats who has long experience of teaching and research and organizing WIPO-India Summer Schools 2017 and 2018 in Collaboration with WIPO-Geneva, RGNIIPM, Nagpur and MNLU, Nagpur is the founder Coordinator of (CIIPR) Center for Innovation and Intellectual Property Rights, which is one of its 17 Centers of Advanced Studies.

The following academic activities are being carried out by the University:

  • Undergraduate Five-Year Integrated B.A.LL.B.(Hons.) Degree Course,
  • Postgraduate One-Year LL.M. Degree Program,
  • Ph.D. Research Degree course both full time and part-time,
  • One Elective Paper on IPR at B.A.LL.B.(Hons.) Degree Course in IIIrd Year in one semester,
  • Specialization in IPR at B.A.LL.B.(Hons.) Degree Course in IV and V Year spread into four semesters,
  • Specialization course in IPR at LL.M. (Postgraduate) One Year Course Program,
  • Specialization in Ph.D. Research Course in IPR.
  • Internship program of students, scholars and researchers for IPR.

AIM

The University is aimed to produce trained scholars, IP professionals, IP Attorney, IP managers by organizing Capacity building workshops in Search and Examination of Patent, Patent filing and drafting, Registration of Copyrights, Designs, Trademark as well as Geographical Indication for protection and promotion of Intellectual Property. These trained professionals will work for the education, promotion, protection of IPRs and zeroing the infringement of Right holders in respective IPR domain. Center will also help in feeding the policy impact and advise to the policymakers for review and drafting the policies to strengthen IP policies.

The Rajiv Gandhi National University of Law, Punjab (RGNUL) will also strive to host and manage the DIPP-IPR Chair. It is pertinent to mention that the University being an autonomous body is catering the needs of IPR Education to its students and researchers. The Head of the Institutions may start the Certificate/Diploma/PG Diploma courses. RGNUL, Punjab, will be competent to manage with its existing resources of expert faculty as well as infrastructure facilities. The proposed Chair will be headed by the experienced and expert Professor of Law in IPR with support of senior faculty members having their expertise in IPR under the able guidance and dynamic leadership of Prof. (Dr.) G.S. Bajpai, as Vice-Chancellor who had been the former Registrar of National Law University Delhi which had been the India’s Top Law University and expert in research and teaching.

VISION

RGNUL, Punjab has designed its curricula for B.A.LL.B.(Hons.); LL.M.; Ph.D. and Post-Doctoral Research (LL.D.) program in consultation of the demand of stakeholders to facilitate Intellectual Property Education and Research to its students and scholars.

(i) Education: The RGNUL, Punjab has introduced IP education in its curriculum as one of the major academic activities for providing undergraduate regular B.A.LL.B.(Hons.) Five-Year Integrated Course; LL.M.(Post-Graduate) One-Year Course; Ph.D. Research work and Post-Doctoral Research (LL.D.) dedicated program including specialized domain of Intellectual Property Law. The University has also adopted MOOCs through SWAYAM, Choice Based Credit Systems (CBCS) on many specialized course including on IPR. University is continuously engaged with students and scholars for their academic excellence through Seminar/Conferences, workshops, research for inculcating a long-standing recognition and respect for One’s IP and others’ IP in the student’s minds.

 (ii) Training: The Center and Chair will cater the needs of training to all the IP stake holders, Agents, Police Personnel, technical persons, IP Managers, Professionals, Scientists, and teacher trainers apart from producing good IP Lawyers with the help of Workshops, Seminars/Conference, Case Study, Policy Review, maintaining database, helping IP filings, Judgment Review and Research projects in the Intellectual Property Rights focusing on Punjab specifically northern Region.

(iii) Research: Intellectual Property Rights (IPR) research is an emerging area in the research and its promotion. Considering wider scope in terms of Agriculture-IPR, Sports, Health and Music Industries in the northern region of country, Intellectual Property Rights education, promotion and protection are the dire needs of the region in view of globalized competitive world. This will boost the economic status of stakeholders, State economy by educating, strengthening and capacity building of the industrialists. Little efforts by the Government helping RGNUL to create enabling milieu by way of modernizing the IPR infrastructure as well as implementing various programs for creation of awareness among the professionals as well as general public will be mile stone of success. Most research that is going on as of now is based on individual initiatives or sponsored research by corporation, which arguably have a very limited scope. The academic or research activities require quality human resources to manage the research positions in terms of financial and technical resources in order to conduct any meaningful in-depth, multidisciplinary and/or mature research in the field of Intellectual Property, which the RGNUL is the perfect choice in this context. These gaps have been very well recognized by the government. Therefore, it is proposed to include research activities as part of the RGNUL, Punjab in the field of IP on a number of socio-legal and Socio-economic parameters, strata of the society, technological fields, R & D trends, etc.

(vi) To establish the IPR- CHAIR-The purpose will be to provide a platform to both trainer and trainees in IP domain. The same will also work for monitoring and collaboration with all the specialized Institutions for IP promotion and protection. IPR Chair will also help the Government, NGOs, Communities, individuals and all the stakeholders too.

(v) Policy Advice

The RGNUL, Punjab has been successful in perceiving a sense of broad perspective along with scholastic and reflexive capabilities of its faculty members, in setting goals for their students to acquaint with Unique kind of Legal education in the country. The students, researchers, scholars and faculty members are of contemporary critical and innovative ideas in drafting policy matters.

The factual research information will also help in instilling the confidence among various groups of population in order to understand the background, necessity at national and international ramifications whether it is a short term or long term effects of any existing or proposed legislation, rules or practices. The activities of IPR Chair will be able to play vital role in the IP policy advice based on result of IP research as well as deliberations or discussions by IP Law experts and multidisciplinary experts. This will not only be important for the government but also to the industry, especially SMEs, MSMEs, Universities, etc. in the country.

Considering the role of RGNUL, Punjab to cater the needs of legal education in the specialized area of IPR as a Prime Educational Institution in Central part of India. However, to bridge the gap in IP education, research, training and policies the IPR Chair will be instrumental with the following are main objectives:

Educations, promotion and protection of IP with the help of online outreach activities, Competitions, Moot         courts etc.

To start with Certificate Course/Diploma/PG Diploma Course(s) in IPR as well as extra credit course certificate.

Promotion and integration of IPR with proposed B.Sc.LL.B.(Hons.), BB.A.LL.B.(Hons.), B.Com.LL.B.(Hons.), B.Tech.LL.B.(Hons.) and Post-Doctoral studies.

Legal Startups/IP Legal Aid Clinics;

Industries –Academia collaboration and shaping the syllabi and upcoming events;

  • To start with Ph.D. Fellowships on Intellectual Property Rights as per the norms of UGC/AICTE.
  • Promotion of more internship program on IPRs for students, scholars, researchers and members of academia.
  • To create public awareness about the economic, social and cultural benefits of IPRs amongst all sections of the society with the help of IP Legal Aid Clinic, Education, Research, Workshop, Seminars, Projects etc. to the General public.
  • Develop, formulate and collate inputs/recommendations industries, practitioners and academia on IPR issues for policy makers.
  • To carry out the Faculty Development programs on Intellectual Property Rights and to foster research in IPR to highlight policy relevance.
  • To carry out the Capacity building programs of IP officials in Industries, Enforcement agencies, Judiciary, NGOs and other stakeholders.
  • Creating IPR knowledge database/Repository by compiling global best practice on IPR matters and Judicial pronouncements on IP Matters.
  • Setting up of a repository for IPR related information and case studies at the University both in physical and electronic form.
  • Preparation of repertoire of resources/toolkit/guidance/instruction materials for various level of IPR Course in education modes/online courses including commissioning of suitable resource persons for the purpose.
  • Studies commissioned by DIPP, will be conducted if the IPR Chair is allowed with prior approval of DIPP.
  • Facilitate Drafting of patent applications and filing other IP applications to strengthen IP as key driver for India’s knowledge driven economy.
  • Collaboration of Indian Academic Institutions and International Institutions.
