Students can choose from one of the three topics:
1. The automobile industry in India is an example of a success story in local manufacturing. The Indian automobile market has matured in the last few years with several market players. Generally in such a scenario, cases of predatory pricing, cartels and other such abuses are observed. Keeping the same in vision, what remedies does the Indian Competition Act provide and how has the jurisprudence been evolving in India? References to comparative jurisdictions would be appreciated.
2. With considerable consolidation and M&A(s) both by overseas companies and Indian companies, the pharmaceutical sector in India has hit hurdles in recent past. What role does CCI play as a regulator in merger control? Provide arguments to establish your position.
3. With the liberalization of the economy and enhancement of market competition, the role played by CCI as a regulator gains utmost importance. While addressing
issues of fair market competition and alleged abuse by market players, the regulator has addressed the concerns of consumers. How do you assess the role of the Competition Commission vis-à-vis the Consumer Protection Redressal Forum as established in India. Please provide arguments supporting your position.
RULES FOR SUBMISSION:
- The word limit for the essay is 2000 – 5000 words (excluding footnotes).
- It shall be required from each person to submit ONLY soft copy via email on [email protected]
- The email should carry subject as, “Submission/Competition Law Essay”/
- Each submission email should contain, the submission as well as scanned copy of Student ID card as issued by the institution.
- The cover page of the submission should contain the following details only:
o Name of Participant
o Contact Number
o Email ID
o Institution
o Course and Year of Study
o Permanent Address
o Title of the Essay
o Abstract of the Essay (250 words) - The main body of the essay should not carry any mention of the name, contact details, or the name of the institution. In any other case, it shall lead to immediate disqualification.
- Co-authorship is not permitted.
- Format of submission should be as per the rules of the competition.
- The soft copy of the essay should be submitted in MS Word file (.doc/.docx).
- All students are expected to acknowledge the primary source(s) of information.
- Multiple entries by an individual shall not be permitted, and shall lead to disqualification.
- Last date of Submission shall be 15th November 2014.
- The result for the competition shall be declared on 20th November 2014.
- Students working with INBA Section for Law Students as ECM’s and Ad-HOC council members are disqualified from participation.
GENERAL RULES:
- The competition shall be open to all students pursuing LL.B (3-year or 5-year Law Course) and LL.M programs from any institution recognised by the Bar Council of India, in India.
- Any essay found to be plagiarised shall be disqualified. (Max. limit 20%)
- The participants are responsible for the originality of the work and agree to indemnify INBA from and against any claims, suits and damages based on any claim of copyright infringement or plagiarism or unauthorized use.
- If at any point in time it comes to light that an infringement or plagiarism has taken place the certificates issued will be revoked, the prize called back & the said occurrence will be mentioned on the web and through media.
- Any previously published material shall not be accepted.
- Footnotes may not be substituted as endnotes, for it shall lead to disqualification.
- In case of a tie, the decision shall be reserved by INBA.
