In the case of Vinay Mishra v.CBI, it was ruled that Section 6 of DSPE Act do not require the
consent of the state in case CBI wants to investigate for the central government officers. The Calcutta high
court have ruled on Wednesday that the CBI can interfere in the offences which are dealt under the Prevention of Corruption Act against the officers of central government even if the offence have
been committed in such a state where CBI does not have any kind of general consent in order to operate
under Delhi Special Police Establishment Act.
Moreover, the officers of the central government who are the offenders under the said act must be dealt
with equality irrespective of the fact that they are working in a distinct state. But the exception to the
rule is that when there is an officer of the state government involved in any case, then consent may be required
under section 6 of the DSPE Act.
