Tomorrow, five-judge Supreme Court Bench, headed by Chief Justice of India J.S. Khehar will pronounce the most awaiting adjudication upon a debatable issue of Triple Talaq that whether it is violative of the fundamental and human rights and prejudice the gender equality and dignity of Muslim women.
Hon’ble Supreme Court heard the matter during summer vacations, the bench was comprised of judges belong from different communities i.e. Sikh, Christian, Parsi, Hindu and Muslim so as to congregate the opinions of different coterie.
SC elucidated during the hearing that it may not deliberate upon the issue of polygamy and said it would only examine whether triple talaq was part of an “enforceable” fundamental right to practice religion by the Muslims. Although court while hearing the matter observed that it is an undesirable practice, nevertheless, some schools of thought which called it “legal”.
