State Government cannot compel the minority Institutions to adopt the Surplus Employees

Petition filed by Shri Balmukund Rathi Shikshan Sanstha in Chandur Bazar in Amravati district in Bombay High Court for seeking the direction against the minority schools to adopt the surplus teachers.
The Sanstha directed the such institution for absorbtion. However, they resisted it.
The sanstha filed the petition against the resistance that State Government cannot direct minority  institutions to absorb surplus employees of other schools unless the minority institution concurs with the absorption.
A division bench of Justices Vasanti Naik and Swapna Naik, while upholding the right of minority institutions, said the state government cannot direct such institutions to absorb surplus employees from other schools unless the institutions concur with the same.
Therefore, HC quashed the action of Amravati Education Officer directing a minority school to absorb surplus teachers.
