On Tuesday, President gave assent to the state law on Jallikattu. NGO Compassion Unlimited Plus Action challenged the law that it violates Prevention of Cruelty Act, 1960 and sought stay on the new law. However, bench headed by Justice Dipak Mishra and Rohinton refused to stay the said law.
SC said that declared object of the new legislation is the preservation of a particular breed of bulls and this need to be debated. Court also allowed the Centre for withdrawal of notification plea.
Mukul Rohatgi, appearing for the Centre, said that jallikattu was a matter of culture and that citizens had the right to take measures to “conserve their culture.”
However, Justice Mishra by referring Section 11 (3) (e) permits slaughter for food but also mandates that the animal should be killed without inflicting upon it unnecessary pain and suffering, he made a remark that conservation of a culture should not involve inflicting unnecessary pain or suffering to animals.
