Supreme Court ordered that no capitation fee should be taken by the institution and it should run on no-profit-no-loss basis.
A five-judge Constitution bench of Justices A R Dave, A K Sikri, R K Agrawal, A K Goel and R Banumathi said that the aim of the educational institutions should not be to make profits. Although nowadays education is treated as occupation and has become fundamental right under article 19(1)(g) and in addition to it lot of capitation fee is charged and it is also commercialized. So, in order to curb this situation government must regulate institutions and take students on merit.
