Great initiative taken by Supreme Court to recourse the public interest.

Today, Bench comprising of Justice Dipak Misra & Justice Naggapan passed the Landmark Judgment, petition filed by Youth Bar Association of India for issuance of writ in nature of Mandamus. Supreme Court direct the respondent to upload every First Information Report (FIR) in whole country on the official website of all states early as possible, preferably within 24 hours from time of lodging FIR.
However, SC provide relaxation to state with difficult terrain and must be uploaded within 72 hours. Moreover, Bench exempted the cases related to terrorism, insurgency & sexual offenses from its directive.
Petitioner contended that FIR is a public document & so the general public has right to get it easily but in reality public has to face many difficulties to obtain FIR from police, it is not an easy task to get it. Therefore, if the FIR will uploaded on website then it would avoid many difficulties which now large number of public is facing.
In November 2015, Allahabad HC directed to upload all FIR’s on official website except in certain circumstances like protect identity of victim, course of proper investigation, public interest. Same direction was also passed by Delhi HC & Himachal Pradesh HC.
Sanpreet Singh Ajmani- National President Youth Bar Association said: “Interest of litigant is supreme.By bringing FIR within the public domain, accused n his family members would be able to take recourse to law at an earliest.” “This judgment would be the mile stone in the history of criminal jurisprudence of our country.” said Peeyush Bhatia- State President of Association, Delhi & Chattisgarh.
