Delhi HC issued notice to centre on PIL seeking Uniform Education

“The world shall be a better place to live according to how we treat our children today”
 
Not only free and compulsory education but quality of education must also be taken care of for educating the children aged 6-14 under article 21(A) of the Indian Constitution. 21(A) must be read along with article 14 and 15 which states equality before law and prohibition of discrimination on grounds of religion, caste, sex or birth place.
High court of Delhi has issued a notice to Ministry of law and justice and Ministry of human resource development in order to provide a common syllabus and common curriculum in a PIL filed by Adv. Ashiwini Upadhyay.
Training and development of mind and knowledge of children plays a very important role in determining a bright future. There must be no discrimination in the quality of education. Removing disparity in quality of education will ensure steps towards socio-economic equality as well as fraternity. It also may be an initial step towards Universal Civil Code. Uniform education would instil a sense of equality and remove disparity and discriminative nature of human beings. The basic idea of RTE is to promote democracy, equality and socio economic justice through elementary education.
As mentioned under article 38(2) and 39 of the Constitution, the state must strive to remove inequalities in income, opportunities and facilities. All the weaker sections of the society must be promoted to bring them in the line of equality. ‘Socio-Economic’ development of the nation is possible if a uniform pattern of syllabus is followed. Article 49 also promotes education and economic interests of weaker sections of the society.
Promoting equality, providing decent standards of living to every person and protecting the rights of the weaker section of the society has always been a priority of the government. The Constitution is also framed in this direction.
The petitioner also prayed in the petition that textbooks on ‘Environment, Health and Safety’ and ‘Socialism, Secularism and Nationalism’ to be issued. Also, chapters on fundamental rights, fundamental duties, directive principles of state policy and golden goals as mentioned in the Preamble must be included in the textbooks.
Some countries have already adopted a uniform education code. In India, the state of Tamil Nadu has ensured uniform syllabus and curriculum in Uniform Education Act. The petitioner has prayed for the same in this line.
Centre has been asked to respond in two weeks by a divisional bench comprising of Justice G. Rohini and Justice S.D. Sehgal.
