Today, the day of verdict of Shahabuddin’s Case in Supreme Court. After hearing both the sides SC cancelled the bail of Shahabuddin which was granted by Patna High on September 7. After the hours of SC order he surrendered before a Siwan court on Friday.
“I respect the judiciary, I don’t care about what people say,” Shahabuddin told reporters before surrendering.
Senior Advocate, Prashant Bhushan argued before the Apex Court that Shahabuddin didn’t follow any rules and walked out of jail at his will. He also said that jail authorities are terrified of him and if he remains on bail then it would be a danger to life of last witness of the case i.e. Chandrakeshwar Prasad.
The court said that a balance has to be maintained between Shahabuddin right to liberty and the apprehension expressed by state that free and fair trial was not possible with him remaining out of jail.
Patna High Court granted bail to him in case Rajiv Roshan, son of Chandrakeshwar Prasad and the sole eye-witness to the cold-blooded murder of his two younger brothers in Siwan. Shahabuddin was convicted in the twin murder case and the trial in the Roshan murder case is yet to commence.
SC directed the trial court to speedily conclude the Rajiv Roshan murder case allegedly involving Shahabuddin.
Therefore, bench headed by Justice Pinaki Chandra Ghosh and Justice Amitava Roy, set aside the order of the Patna High Court and ordered that he must be taken into custody immediately.
