Brazilian Lady has filed a petition of Habeas Corpus to produce & release of her brother, Dante Farinello Cardoso who was convicted in connection with forgery & cheating.
Shree Pal Singh, who filed the said petition & settled by Advocate will Mathews allege that conviction was null & void, was Prima Facie illegal. It was duty of Trial Court to provide a translator as he was Brazilian not having knowledge of English & Hindi.
Brazilian Lady stated that the detenu is Portuguese & he was compelled to face trial in hindi & was convicted by CJM,Maharganj for S. 420, 468, 467 IPC & S. 14 Foreigners Act, sentenced for 5 years of rigorous punishment & fine of 5000. It was upheld by ASJ & confirmed by HC of Allahabad.
Embassy of Brazil stated that his passport was original, letter adressed issued to Advocate was contradictory to finding of HC on issue of legality & validity of passport.
