Azam Khan's statement on Bulandshahr case under judicial scanner.

In the name of freedom of speech and expression, the statement made by Azam Khan, a leader of Uttar Pradesh’s leading Samajwadi Party is under judicial scanner. The statement was regarding the Bulandshahr rape case where he termed the mother and daughter to be under some ‘political conspiracy’ to defend his party. The Supreme Court has issued notice to him.
A PIL was filed by the victim’s father against this insensitive statement and also requested to shift the case to the Delhi in order to get justice.
Previously, Allahbad HC had ordered CBI probe into the case, however the SC has stayed it.
Senior lawyer, F.S. Nariman is appointed as the amicus curiae and the case would be taken up after 3 weeks. The bench Justices Deepak Mishra and C. Naggappan framed some constitutional questions to be answered.
The foremost question is, when an FIR is lodged against any gangrape case or heinous crime, whether any person holding any public office or who is in authority has the right to comment on the crime even when he is not concerned with the offence.
Should the state which is the protector and responsible for law and order situation allow such comments, which may create distrust in the mind of victim?
The bench would also check whether such statements come inside the ambit of freedom of speech and expression.
The bench further asked that whether the constitutional compassion and sensitivity is affected due to such comments.
The victims also alleged that no help reached them when they dialled 100.
The brutal incident happened on 29th July night when a family was heading towards Shajahanpur from Noida on NH-91. Mother and daughter were dragged 100 metres away where they were gang raped and cash along with jewellery was stolen away.
Such statements outrage the modesty of the rape victims and the family. Appropriate compensation is also demanded in the plea.
