Apelles were directed against a special Bench Judgment of Orissa high court as of January 25,1999.
According to the judgment passed some of the directions contained in the earlier full bench decision had been set aside. The applets were head masters of different private schools which later became Aided Educational Institutions and finally became full-fledged Government Schools.
According the judgment of Orissa High Court they could not continue as head masters of the respective schools.
The case of Golakh Chand Mohnaty vs State of Orissa was considered by the previous bench.
The honourable Court ordered that it is not disputed that with effect from 25/09/1997 regulation 17 in secondary board education has been brought into force. Due to this it is obligatory for every institution to have a head master who must be trained, graduated and should have 7 years of teaching experience, and if subsequent to 25/09/1997 any appointment has been made which is contrary to the above provisions then the appointed is said to be invalid .
Since the appeals failed therefore the honourable court dismissed the claim.
