Constitutional Bench will adjudged the constitutionality of Triple Talaq

The Batch of petitions filed in the top court regarding Triple Talaq, accordingly issues have been framed that whether divorce by saying ‘talaq’ three times is legal or whether it restricts equal rights or in this case, women’s rights, and whether freedom to practice religion takes precedence over basic freedoms provided by constitution.
For above said ambiguities, today Supreme Court decided that a five-judge constitution bench will rule on the constitutional validity of the practice of triple talaq , ‘nikah halala’ and polygamy among Muslims.
Bench will sit during the summer vacation to examine the issue. The hearing will begin on May 11. Reason behind for hearing of this matter during summer vacation is Early disposal of matter, “If we don’t take up these cases, they will be pending for years,” CJI J.S. Khehar said.
Last month during the hearing of petitions SC made clear to the parties concerned that it would not deal with the factual aspects of particular cases and would rather decide the legal issue
