Husband and In-laws of deceased woman has been acquitted by the Court in Delhi on the ground that prosecution has failed to prove the case. Prosecution witnesses hasn’t uttered anything which would support the conviction of accused and failed to support the report submitted by police.
The couple got married in May 2011. They were living in Dwarka, Southeast Delhi with her husband’s parents. It was alleged that woman was tortured by husband and in-laws to bring in more dowry and on September 9, 2012, she was found dead in her matrimonial home.
Case was lodged against the husband and in-laws under sections 498A (husband or relative of husband of a woman subjecting her to cruelty), 304 B (dowry death) and 34 (acts done by several persons in furtherance of common intention) of the IPC.
“No incriminating evidence has come on record against the accused persons and the prosecution has miserably failed to prove its case against them for the commission of offences under sections of IPC,” Additional Sessions Judge Sanjay Garg said.
Accused said “falsely implicated in the case and the victim was under depression due to which she committed suicide”.
