RAPE a word of four letters is such a heinous crime against women which not only hurts them for a minute but shatters their whole life. The newspaper is again haunted by one such news of Gurmeet ram rahim singh rape case.
The Supreme Court today dismissed a petition of Dera Sacha Sauda chief Gurmeet Ram Rahim Singh seeking more handwriting samples of an alleged rape victim in a 14-year-old case, and said that a woman is not available, just because she writes “Babaji, I love you”.
The alleged incident is of 1999 and FIR was lodged in 2002 when a woman (sadvi) wrote an anonymous letter in 2002 to then Prime Minister Atal Behari Vajpayee accusing the Baba of sexual abuse, the Punjab and Haryana High Court ordered a CBI probe into the complaint. Since then, the cbi has filed charge sheet against the Baba.The case is currently pending in a CBI special court at Panchkula.
The senior advocate Jayant Bhushan, appearing for the religious figure-head, said this letter was a crucial piece of evidence and is inconsistent with the allegation “The alleged incident is of 1999 and the letter was written in 2001. FIR was lodged in 2002. More handwriting samples will help in my defence,to this, the bench asked the counsel to read the content of letter and said whether it is rape or not can be proved through the evidence in the trial court. Bhushan after reading the content said the letter was anonymous and the complaint was lodged on that basis.The bench then asked, “just because the victim writes ‘Babaji I love you’, does that mean I am available?”
A bench comprising Justices Dipak Misra and C Nagappan said the tenor and the language of the letter allegedly written by the victim does not show consent at any point.
Just because a girl is showing her devotion and love for someone does not means she is giving her consent or she wants to be raped.
The culture and tradition of India is considered as old and great all over the world where people used to worship various female goddesses like “MAA” DURGA, LAXMI etc. But see the irony taking birth as a woman in the Indian society can be said as curse for the women. Our supreme law of land i.e. our Indian Constitution has envisaged a dream of true social, economic and political democracy which guarantees the rich and moral principles of equality (of status, opportunity, law) for our citizens but this has not yet been fully realized.Still our better halves are unsafe and insecure towards the realization of freedom and liberty. It’s unbearable to imagine the plight of women who are sufferers of such crimes. It’s a jolt on the confidence of the women, of society and on our judicial system. Besides it has much of cascading effects which affects her life.
