Appeals were against the orders of different central administrative tribunals. The respondents were employees of the unit-run canteens which provided canteen facilities to the troops at the unit level. These employees filed the application claiming benefits as regular defence personnel or at least civilian employees serving under ministry of defence.
The court observed that in the Defence services there are two types of canteens (1) canteen store department (2) Unit- run canteens
It was observed that the canteen store department was existing even during the pre- independence era. The Court further said that a set of rules are made which confers that unit-run canteens comes under the department of ministry of Defence. Though the funding of it is not made out of consolidated fund of India but this department comes under Ministry of Defence of India.
Appeal was disposed of after making above observations.
